Canadian Immigration Options for my Partner or Spouse

If you are a Permanent Resident of Canada or Canadian Citizen there are a few options for bringing your partner or spouse to Canada. We can help you understand the time lines and the options that may be available to find an immigration solution that works for you. 

A lot of people ask about the options that are available to them if they have a partner who is living overseas, or a partner who is in Canada on a temporary basis.  In general terms, the following three options are available to most couples who want to remain in Canada or permanently immigrate to Canada: 


1) Apply for permanent residency
through the Spousal Sponsorship or Common-Law Partner category of immigration. You would have the option to apply within Canada or outside of Canada, see the Pros and Cons for more information about applying from inside of Canada or applying from outside of Canada is 
 


2) Apply for a Study Permit.
  With a study permit your partner would be allowed to stay in Canada.  Depending on the field of study, it can qualify your partner for permanent residence in a few years.  If they are a full time student he/she can receive an open work permit while in school or they can work on campus. 
 


3) Apply for a Work Permit.
  Your partner would need to find an employer in Canada who will offer them a temporary or permanent job placement.  The employer would need to have a Labour Market Opinion (LMO) which allows them to hire international workers.  The employer needs to show that they were unable to hire a Canadian worker and that your partner is the right fit for the position.  


Processing times for each of these options varies greatly depending on a number of factors including your circumstances and country of nationality.
